TALENT; TERM LETTER OF AGREEMENT

1. General Terms


·                  Talents' representation/registration by and through ANOM!LE will be bonded for one year (12 months) from date of signing. 

·                  Talents' promotional billing for performances shall be registered through ANOM!LE, but, is not limited to opportunities, sourced by ANOM!LE. 

·                  Talent is subject to "take direction" from ANOM!LE administration, concerning ANOM!LE-affiliated events/projects, however, this does not include "creative control" of Talents' prior body of work.

·                  Talent is expected to perform, make appearances on time during specified ANOM!LE (and affiliate) events, make practices, rehearsals and soundchecks, rallies, learn and take instruction in workshops, develop their act and themselves as a marketable creative artist.

·                  Talent’s contract includes, but is not limited to performances. It also includes all multimedia production, promotional work, human resources, produced and/or sourced by ANOM!LE, its subsidiaries and/or affiliates.

·                  Concerning ANOM!LE sourced bookings, Talent is entitled to a percentage of 85% of agreed earnings for executed performance dates, levied against 15% management/booking fee to ANOM!LE and any unpaid production costs.

Production Costs or “bond” = studio production, wardrobe, props, business cards, press kits, promotion, etc. sponsored by ANOM!LE are to be itemized, logged and reserved as a bond balance. The balance must be currently paid in full, in order to begin to receive money from performance dates, fulfilled.

·                  Talent is entitled to 5% of net receipts, less 50% distribution fee, production and licensing costs, from merchandising using Talent’s name and image/likeness, reducible to 2.5% if any other Talents’ name and/or image is in connection per item.

·                  Talent has a right to photographic and non-photographic/resubmission approval of at least 50% of the images and likenesses or “drawn likenesses” of the Talent for press pending Talent is not in default and has paid or optioned their bond balance. After 48 hours, no notification of disapproval, ANOM!LE deems it as Talent’s approval.

·                  Talent has privileged limited access to available stock (equipment), resources and/or amenities, afforded to them (upon written request and proper clearance by the head of ANOM!LE), but, if lost, stolen, damaged or broken, Talent assumes full financial responsibility for the cost of repair or replacement of part or the whole.

·                  ANOM!LE assumes no financial, legal nor civil liability/responsibility for damage nor harm, done to persons and possessions due to Talents' act(s) of irresponsibility/negligence (open bar tabs, altercations, vehicular accidents/repairs, lost/stolen equipment, car boots, tickets, fines, ruined pants, etc.).

2. Completion and Continuance
Upon completion of contracted year (the date of signing, the next year), the current contract becomes null and void. If continuance is desired, by both parties, a new contract must then be renegotiated and re-issued, for signing (plus any additional conditions).

Products, services and trade, facilitated through this contract will be itemized, dissolved/liquidated as such:

·                  Lessons/workshops provided, soft production services rendered (engineering, remixing), supply/equipment usage or access and any applicable costs, logged, may be discounted upon completion of the contracted year, if continuance is desired (discount percentage pending Talent’s merits the past year).

·                  Rendered multimedia product, publishing, promotional costs, copy, totaled and logged, may be dissolved or optioned during negotiation of new contract.

·                  However, if a continuance is not desired, then the total production cost must be paid off by Talent that they may be eligible to license and copyright negotiation. Until then, Talent may not use graphics, photos, video, music, the name of ANOM!LE nor those of its affiliates for personal/amateur nor professional promotion or airing in any media throughout the universe(s) in perpetuity, under penalty of law.

3. Early Dissolution and Firing/Quitting (Breach Of Contract)
If the Talent wishes to dissolve the contract (ie., quit), before the contracted year has been completed, Talent may do so by paying the remaining bond balance, plus closing cost percentage of 25%.

·                  Upon the above-stated dissolution, certain learned artistic license (eg, trademark stage techniques or skills, attained though, learned from or sponsored by ANOM!LE, etc.) remains intellectual property of ANOM!LE, suspended for no less than 6 months from the date of dissolution.

·                  All exclusive license to ANOM!LE produced and sponsored multimedia and image- oriented property (eg, press photos, video,  ANOM!LE registered stage/character name(s), stage acts, props, wardrobe, etc.) remains property of ANOM!LE, in all media throughout the universe(s) in perpetuity, to only be used by another party, by written permission from ANOM!LE, pending purchase of license by payoff of bond.

ANOM!LE reserves the right to dismiss, relieve from duty and/or fire the Talent, under situations of repeated insubordination, theft, social/professional impropriety, hazardous activity and/or wanton behavior or technically for any reason deemed necessary. 

If Talent is fired by ANOM!LE, the firing stands as an agreed early dissolution, by wishes of ANOM!LE, forfeiting any rights to immediately recoup bond balance, in full, but, subjecting Talent to the above stated six month suspension of intellectual properties and the indefinite ineligibility to copyright license of any and all rendered multimedia produced or sponsored by ANOM!LE until bond balance is paid.

I, the undersigned, have read, understand and agree to the terms of this agreement, legal and binding, between myself (the Talent) and ANOM!LE.
